NOTICE OF PROPOSAL TO STOP UP PARTS OF THE HIGHWAY
NOTICE IS HEREBY GIVEN that the Council of the Royal Borough of Kingston upon Thames ("the Council") proposes to make an order under section 247 of the Town and Country Planning Act 1990 ("the Act") authorising the stopping up of an area of highway in Eden Street and Lady Booth Road, measuring approximately 36.5 square metres being part of the footway adjoining Eden House, 62-68 Eden Street, Kingston upon Thames, KT1 1EL, measuring approximately 6.00 metres long by 1.50 to 2.00 metres wide (variable) running north to south in Eden Street, 2.00 metres long (curved) by 1.50 metres wide (curved) at the junction of Eden Street and Lady Booth Road and 20.50 metres long by 0.50 metres wide running west to east in Lady Booth Road.
The general effect of the Order, if made, would be that the said land would cease to be highway.
The Council is satisfied that it is necessary to stop up those parts of the footway in Eden Street and Lady Booth Road to enable the implementation of a planning permission granted by the Council on 30 October 2015 (Ref. No. 15/12343/FUL) for the development at the site at Eden House, 62-68 Eden Street, Kingston upon Thames, KT1 1EL, for the demolition of the existing retail/office building and redevelopment of the site to provide a mixed use building with retail (Class A1) / financial & professional services (Class A2) / cafe or restaurant (Class A3) use on the ground and basement levels and 39 apartments (Class C3) from the first to the sixth floor, together with ground floor level accessible car parking.
A copy of the draft order and Plan may be inspected free of charge at the Council Offices at the Reception, Guildhall, Kingston upon Thames, KT1 1EU, from 9.00am to 5.00pm Monday to Thursday and 9.00am
to 4.45pm on Friday (excluding bank and public holidays) until the
16th January 2017.
Anyone wanting to object to the making of the order should write to the Council care of South London Legal Partnership, Gifford House, 67c St Helier Avenue, Morden, SM4 6HY, quoting reference CS/LEG/AN/1749/9 before 16th January 2017. (being not less than 28 days following the date of publication of the notice)
