A teenager has been found not guilty of stabbing a fellow student outside Richmond College after no evidence was offered in court.

David Gergi, 18, from Westminster, had been due to go on trial after it was alleged he stabbed another boy with a knife in Court Way, Twickenham, on May 14, 2014.

But the trial, set to begin at Kingston Crown Court this morning, never got started due to a lack of evidence, prompting Judge Jonathan Kinnear QC to find Mr Gergi not guilty and brand the case a "shambles".

Discussing whether the trial could take place or not, he said: "It is a shambles, this case, nobody has a clue what is going on.

"I don't know how the Crown Prosecution Service (CPS) expects to proceed a case of this seriousness without a file being in court."

He eventually ended the trial before it had even begun after rejecting prosecutor Abigail White's application to admit "hearsay" evidence from the alleged victim, who refused to attend court.

Judge Kinnear said he did not accept the victim was failing to attend the trial because of fear of any repercussions.

Mr Gergi, who faced one charge of grievous bodily harm and another of carrying a knife, attended the hearing wearing a blue suit and was told he was free to go.

Judge Kinnear added: "Stay out of trouble and don't come back here again."
